Terms governing your use of the JustBE Consulting website and purchases made through our online store.

Welcome to JustBE Consulting. These Website & Online Store Terms and Conditions
(“Store Terms”) apply to your use of the JustBE Consulting website and to products, packages,
consultations and other services purchased through our website and online store.

JustBE Consulting is operated by JustBE Coaching Company (Pty) Ltd
(“JustBE Consulting”, “JustBE”, “we”, “us” or “our”).

Please read these terms carefully.
By using this website, submitting an enquiry, creating an account, placing an order,
booking a consultation or purchasing a product or service through our online store,
you acknowledge that you have read and understood these Store Terms.

administration, project delivery, marketing, digital implementation and related
professional services to entrepreneurs, SMEs, consultants, professional service
providers, startups, non-profit organisations and growing businesses.

a displayed “starting from” or estimated price does not necessarily constitute
a fixed quotation for your specific project.

Where a proposal, quotation, statement of work or service agreement is issued,
that document will set out the specific scope, deliverables, fees, timelines and
other requirements applicable to that engagement.

4. Online Purchases

Where products or services are available for direct purchase through our online
store, you may place an order by completing the applicable checkout process.

You are responsible for ensuring that all information supplied during checkout
is accurate and complete.

An automated order confirmation confirms that we have received your order.
Acceptance of an order may be subject to payment verification, availability,
scope confirmation or other reasonable checks.

5. Custom Projects & Quotations

Custom projects are generally quoted according to the scope, complexity,
deliverables, required resources and proposed timeline.

Custom projects may include:

  • Business process redesign;
  • CRM implementation;

  • Tender and bid projects;
  • Documentation systems;
  • Client onboarding systems;
  • Automation implementation;

  • Other business support requirements agreed with the client.

A project will only be considered formally approved once the applicable quotation,
proposal, service agreement or statement of work has been accepted and any required
deposit or initial payment has been received.

6. Scope of Work

The agreed scope of work determines what is included in a purchased service or
project.

Requests that fall outside the agreed scope may be treated as additional work
and may incur additional fees.

Where additional work is required, we will endeavour to communicate the additional
requirements and costs before proceeding.

7. Prices & Currency

Prices displayed on our website may be presented in South African Rand (ZAR),
United States Dollars (USD), British Pounds (GBP), or another clearly indicated
currency depending on the service or customer location.

Where applicable, taxes, transaction charges, delivery charges or other additional
costs will be identified before completion of the purchase.

Prices may change from time to time. Changes to pricing will not ordinarily affect
an order or quotation that has already been accepted and paid for, except where an
obvious pricing or administrative error has occurred.

8. Pricing Errors

We take reasonable care to ensure that pricing information is accurate.
However, technical, administrative or typographical errors may occasionally occur.

Where an obvious error has resulted in an incorrect price, we reserve the right,
to the extent permitted by law, to correct the error and contact the customer
regarding the affected order.

Where appropriate, the customer may choose whether to proceed at the corrected
price or cancel the affected transaction.

9. Payment

Payments made through the website are processed using the payment methods made
available during checkout.

By submitting a payment, you confirm that you are authorised to use the selected
payment method.

Payment processing may be handled by independent third-party payment providers.
Your use of those payment services may be subject to the provider’s own terms
and conditions.

10. Deposits & Upfront Payments

Certain projects or services may require a deposit, consultation fee, upfront
payment or other initial payment before work commences.

Where a payment is described as a deposit or commencement payment, the applicable
quotation or service agreement will specify how that payment is treated.

Payment of a deposit does not automatically mean that all work requested by the
client is included in the agreed project scope.

11. Consulting Sessions

Where a consulting session is purchased through the website, the applicable
session duration, purpose and deliverables will be described on the relevant
product or booking page.

A consultation is intended to provide professional guidance, strategic input
and practical recommendations based on the information made available by the
client.

A consultation does not automatically include implementation, project delivery
or ongoing support unless expressly stated.

12. Appointments & Rescheduling

Where an online purchase includes a scheduled consultation or appointment,
the customer is responsible for attending at the agreed date and time.

Rescheduling and cancellation are governed by our
Refunds & Cancellation Policy and any specific appointment
terms communicated at the time of booking.

13. Business Support Packages & Retainers

Monthly packages and retainers provide access to an agreed level of support,
subject to the specific package or service agreement purchased.

Package hours, deliverables, response times and included services may vary
between packages.

Unused hours or services do not automatically carry forward from one month
to the next unless expressly agreed in writing.

Additional work requested outside the agreed package may be quoted or billed
separately.

14. Project Timelines & Client Responsibilities

We will make reasonable efforts to meet agreed project timelines.
However, delivery dates may depend on the timely provision of information,
content, approvals, credentials, feedback and other materials from the client.

Where delays are caused by missing information, delayed approvals, changes in
scope, third-party dependencies or circumstances outside our reasonable control,
the project timeline may need to be adjusted.

Clients are responsible for:

  • Providing accurate information and materials;
  • Providing access credentials where required;
  • Reviewing work within agreed timeframes;
  • Providing timely approvals and feedback;
  • Ensuring that supplied content is lawful and accurate; and
  • Maintaining appropriate backups of their own business data and systems.

15. Websites, Domains & Third-Party Platforms

Where we provide website development, SEO, digital marketing or technology
services, the work may involve third-party platforms such as WordPress,
hosting providers, domain registrars, Google, Meta, email platforms,
plugins, software applications and other technology providers.

Third-party platform fees, hosting fees, domain registration fees, premium
plugins, subscriptions, advertising spend and other external charges are
not included unless expressly stated in the quotation or service agreement.

We cannot guarantee the continued availability, functionality, ranking,
performance or pricing of third-party platforms.

16. SEO & Marketing Services

SEO, advertising and marketing services are intended to improve visibility,
positioning, traffic, engagement or other agreed marketing objectives.

Search engine rankings, advertising performance, leads, sales, engagement
and revenue are influenced by many factors outside our control.

We therefore do not guarantee specific rankings, traffic volumes, lead numbers,
sales figures or financial results unless a specific written agreement expressly
provides otherwise.

17. Tender & Bid Support

Where JustBE Consulting provides tender, bid or proposal support, our role is
to assist with the preparation, organisation, administration and presentation
of the submission according to the agreed scope.

We do not guarantee that a tender, bid or proposal will be successful.
Final decisions remain with the relevant procuring organisation or awarding body.

18. Freelancer Network

JustBE Consulting may connect clients with independent freelancers and
professional service providers through our freelancer network.

Important: A freelancer listed within our network is not
automatically an employee of JustBE Consulting. Unless otherwise agreed in
writing, independent freelancers remain responsible for their own services,
professional obligations, deliverables, pricing and client relationship.

Where JustBE Consulting is specifically engaged to manage a project, coordinate
delivery or provide quality assurance, our role and responsibilities will be
defined in the applicable proposal, quotation or service agreement.

Clients should conduct appropriate due diligence before engaging an independent
freelancer directly.

19. Intellectual Property

Unless otherwise agreed in writing, all intellectual property belonging to
JustBE Consulting remains the property of JustBE Coaching Company (Pty) Ltd
or the relevant third-party rights holder.

This includes:

  • Website content;
  • Branding and logos;
  • Templates;
  • Frameworks;
  • Processes;
  • Training materials;
  • Documentation;
  • Graphics;
  • Written content;
  • Digital resources;
  • Website layouts and original design elements; and
  • Other proprietary materials.

Where a project includes the creation of client-specific deliverables,
ownership and licensing rights will be determined by the applicable proposal,
quotation or service agreement and, where relevant, payment in full.

20. Client Materials

You retain ownership of materials, information, branding, documents, images,
data and other content that you provide to us.

By providing these materials, you confirm that you have the necessary rights,
permissions and licences for us to use them for the purpose of delivering the
agreed service.

You remain responsible for ensuring that client-supplied materials do not
infringe the rights of another person or organisation.

21. Confidentiality

We understand that clients may provide confidential business, operational,
financial, marketing or strategic information during an engagement.

We will take reasonable steps to protect confidential information and will
use it only for legitimate purposes connected with providing the agreed
services, subject to applicable law and any separate confidentiality or
non-disclosure agreement.

22. Privacy & Personal Information

Personal information collected through our website, forms, checkout process,
consultations and service delivery will be handled in accordance with our
Privacy Policy and applicable South African data protection requirements.

Information may be shared with appropriate third-party service providers where
reasonably necessary to process payments, deliver services, manage projects,
provide technology services or otherwise fulfil the purpose for which the
information was collected.

23. Refunds & Cancellations

Refunds, cancellations, rescheduling and related matters are governed by our
Refunds & Cancellation Policy.

Because many JustBE Consulting services involve preparation, allocated time,
customised work or third-party resources, cancellation terms may vary according
to the nature and stage of the engagement.

Nothing in these Store Terms or our Refunds & Cancellation Policy is intended
to exclude or limit any consumer right or remedy that cannot lawfully be
excluded or limited.

24. No Guaranteed Business Outcome

Our services are designed to provide professional expertise, practical support,
strategy, implementation and business assistance.

However, business outcomes depend on numerous factors, including the client’s
decisions, implementation, market conditions, financial resources, customer
behaviour, competitors and external circumstances.

We therefore do not guarantee a particular increase in revenue, profit,
clients, leads, rankings, funding, tender success or other commercial result
unless expressly agreed in writing.

25. Limitation of Liability

To the maximum extent permitted by applicable law, JustBE Consulting will not
be liable for indirect, incidental, special or consequential losses arising
from the use of our website, products or services.

We will not be responsible for losses caused by circumstances outside our
reasonable control, including failures of third-party platforms, hosting
providers, payment providers, internet services or software systems.

Nothing in these terms excludes or limits liability where such exclusion or
limitation is prohibited by law.

We endeavour to maintain a reliable and secure website but cannot guarantee

Where a specific service agreement, proposal, quotation or statement of work
contains terms that specifically govern a particular engagement, those terms
will apply to that engagement to the extent of any inconsistency.
